A Lei Seca brasileira, que tem tolerância zero para concentração de álcool no sangue de qualquer motorista, está entre as mais rígidas no mundo, ao lado de países, como Hungria, Romênia, Eslováquia, República Tcheca, Marrocos, Paraguai e Uruguai – sem contar os países que baniram o álcool por motivos religiosos.
Essa regra é mais exigente que a recomendação da Organização Mundial de Saúde (OMS) de limites menores que 0,5 g/L no sangue para motoristas em geral e abaixo de 0,2 g/L para jovens condutores (até 21 anos).
No último levantamento da entidade, divulgado em 2015, apenas 34 países cumpriam essas duas recomendações, sendo 21 deles na Europa. No entanto, a maioria dos países europeus têm leis mais permissivas que as brasileiras.
A Alemanha, por exemplo, permite concentração abaixo de 0,5 g/L no sangue e 0,25 mg/L no bafômetro, enquanto a Inglaterra tem limite de 0,8 g/L no sangue e 0,35 mg/L no ar expelido.
No Brasil, há apenas uma tolerância para registros abaixo de 0,05 mg/L no bafômetro por causa de uma margem de erro do aparelho, mas no exame de sangue não há limite algum.
Além disso, enquanto um motorista com 0,6 g/L no sangue ou 0,34 mg/L no bafômetro não recebe nem multa na Inglaterra, no Brasil ele pode ser preso com a mesma concentração.
Isso não significa, contudo, que o Brasil está melhor que estes países na segurança viária. O Reino Unido registrou em 2013 uma das menores taxas de mortes em acidentes no mundo (2,9 mortes por 100 mil habitantes) e a Alemanha não ficou muito longe, com 4,3.
Já o Brasil estava neste mesmo ano ao lado de países como Botsuana, Argélia e Namíbia, com 23,4 mortes a cada 100 mil habitantes. Em 2017, este número foi de 15,7, segundo dados preliminares do Ministério da Saúde e do IBGE.
