Canudos plásticos passam a ser proibidos no estado de São Paulo

O governador de São Paulo João Doria (PSDB) sancionou neste sábado (13) um projeto de lei que prevê a proibição de fornecimento de canudos plásticos em estabelecimentos comerciais do estado. De autoria do deputado estadual Rogério Nogueira (DEM), o texto estipula multa para quem descumprir a lei, com valor de aproximadamente R$ 5.300, que será dobrado em caso de reincidência. 

Um dos artigos do projeto estabelecia o prazo de um ano para que a lei fosse implementada, mas ele foi vetado pela gestão Doria, que o classificou como “inconstitucional” ao argumentar que a determinação de prazos é de competência exclusiva do Executivo. Não há, no momento, um prazo oficial para que a lei seja regulamentada, portanto. 

O texto também estabelece que todos os valores arrecadados com multas a hotéis, restaurantes, bares, padarias, clubes noturnos, salões de dança e eventos musicais, entre outros estabelecimentos de qualquer espécie no estado, serão destinados a programas ambientais.Em junho, o prefeito de São Paulo Bruno Covas (PSDB) sancionou projeto de lei similar e terá pouco menos de seis meses para regulamentar a lei, especificando quem serão os responsáveis por fiscalizar as possíveis infrações, como estarão distribuídos pela cidade e como serão feitas campanhas de conscientização dos comerciantes, por exemplo. 

No Brasil, cidades litorâneas como Fortaleza, Salvador, Rio de Janeiro, Camboriú (SC), Ilhabela (SP), Santos (SP), Rio Grande (RS) e todo o estado do Rio Grande do Norte já sancionaram leis de proibição dos canudos e de outros plásticos descartáveis.Nas redes sociais, Doria escreveu que  a aprovação da medida alinha São Paulo aos “grandes centros urbanos do mundo”, classificando a redução dos plásticos de uso único como “um dos maiores desafios ecológicos contemporâneos.” 

“[A proibição] visa o combate à poluição do meio ambiente e evita que animais marinhos morram com a ingestão de materiais plásticos”, completou.Reportagem da Folha de S.Paulo mostrou que no Rio de Janeiro, onde a lei anticanudos foi aprovada em julho de 2018, a proibição “pegou” e criou uma nova cultura entre grande parte dos cariocas, mas não é difícil encontrá-los em certos locais, como barracas de praia ou vendas de ambulantes. 

No período em que valeu a primeira versão da lei, de outubro de 2018 ao começo de janeiro deste ano, a gestão do prefeito Marcelo Crivella (PRB) afirma que só aplicou quatro multas por uso indevido de canudos, entre mais de 15 mil inspeções. 

Discussões fizeram com que a lei fosse substituída por outra, em janeiro, ampliando a permissão a canudos de qualquer material biodegradável –desde que não de plástico ou oxibiodegradável (que dificulta a reciclagem). Dessa vez, o prazo de adaptação previsto foi de quatro meses, que se esgotou em 9 de maio.  

Os canudinhos representam 0,03% das 6 milhões de toneladas de plástico produzidas no Brasil em 2016, segundo números do IBGE divulgados pela Associação Brasileira da Indústria do Plástico (Abiplast).  

Ainda de acordo com a associação, cerca de 35% dos produtos do setor têm ciclo de vida curto, de até um ano, e só 26% das embalagens plásticas são recicladas, diz uma pesquisa da FIA (Fundação Instituto de Administração, da USP) também de 2016.
