O trabalho de carpintaria na construção de um resort próximo a lagoa do Manso (129km de Cuiabá) mantinha um profissional exposto ao sol durante toda a sua jornada.
Como a exposição ao calor ultrapassou os limites de tolerância estabelecidos em norma de segurança no trabalho, o Tribunal Regional do Trabalho de Mato Grosso (TRT/MT) determinou o pagamento de adicional de insalubridade.
Como ‘carpinteiro telhador’, ele fazia a cobertura dos bangalôs do empreendimento. O trabalho a céu aberto o deixava exposto diariamente a agentes nocivos à saúde, como poeira, cimento e radiação solar, tudo sem a utilização de Equipamentos de Proteção Individual (EPIs) adequados.
O perito designado para o caso concluiu que a atividade desenvolvida possuía agentes insalubres em grau médio, por exposição ao calor do sol acima do limite permitido pela Norma Regulamentadora 15, que trata de atividades e operações insalubres.
Com base no laudo do perito, a juíza substituta da 6ª Vara do Trabalho de Cuiabá, Márcia Pereira, condenou a empresa a pagar o adicional de insalubridade e reflexos e compensação por danos morais. A empresa recorreu da decisão, mas a 2ª Turma do TRT/MT manteve a condenação no percentual de 20%.
Conforme o relator do processo no Tribunal, desembargador Osmair Couto, o entendimento do Tribunal Superior do Trabalho (TST) é no sentido de que o trabalho a céu aberto, com exposição a calor excessivo, confere ao trabalhador o direito ao adicional de insalubridade no caso de exposição acima dos limites de tolerância. “Constatado por meio de perícia técnica que o trabalhador estava exposto ao agente físico calor superior aos limites de tolerância para a atividade desempenhada, o adicional de insalubridade é devido”.
A orientação jurisprudencial 173 do TST estabelece que tem direito ao adicional de insalubridade o trabalhador que exerce atividade exposto ao calor acima dos limites de tolerância, inclusive em ambiente externo com carga solar.
