STF concede prisão domiciliar a presas grávidas ou com filhos de até 12 anos

A Segunda Turma do Supremo Tribunal Federal (STF) decidiu hoje (20) conceder prisão domiciliar a todas as mulheres presas preventivamente que estão grávidas ou que sejam mães de crianças de até 12 anos. A medida vale somente para detentas que aguardam julgamento e não tenham cometido crimes com uso de violência ou grave ameaça, e também vai depender da análise da dependência da criança dos cuidados da mãe. Cerca de 4 mil mulheres devem ser beneficiadas.

A decisão foi tomada a partir de um habeas corpus protocolado por um grupo de advogados militantes na área de direitos humanos, com apoio da Defensoria Pública da União (DPU). A medida vale para presas que estão em uma lista do Departamento Penitenciário Nacional (Depen) e que foi remetida ao Supremo pela DPU.

De acordo com a decisão, os tribunais de Justiça do país serão notificados sobre a decisão e deverão cumprir a decisão em 30 dias. Os parâmetros também deverão ser observados nas audiências de custódia.

Ao votar pela concessão da prisão domiciliar, o relator do caso, ministro Ricardo Lewandowski, entendeu que concessão do habeas corpus coletivo se justifica diante da realidade degradante das mulheres nas prisões brasileiras, com detentas sem atendimento pré-natal e casos de presas que dão à luz algemadas.

Em seu voto, Lewandowski citou dados que mostram que somente 34% das prisões têm celas para gestantes, 30% possuem berçários e apenas 5% têm creche.  “Seguramente, mais de 2 mil pequenos brasileirinhos estão atrás das grades com suas mães, sofrendo indevidamente contra o que dispõe a Constituição”, argumentou o ministro.

O entendimento do relator foi seguido pelos ministros Dias Toffoli, Gilmar Mendes e Celso de Mello. O ministro Edson Fachin foi o único a votar contra a medida, por entender que a prisão domiciliar para lactantes deve ser analisada caso a caso.

Durante o julgamento, a DPU e entidades de defesa de direitos humanos pediram que fosse aplicada a todas as mulheres presas no país a regra prevista no Artigo 318 do Código de Processo Penal (CPP), que determina a substituição da prisão preventiva pela domiciliar para gestantes ou mulheres com filhos de até 12 anos incompletos.

Apesar de estar previsto no Código de Processo Penal, a Justiça entende que a concessão dos benefícios às gestantes não é automática e depende da análise individual da situação de cada detenta.

A Defensoria argumentou que o ambiente carcerário impede a proteção à criança que fica com a mãe no presídio. O órgão também destaca que algumas mulheres são mantidas algemadas até durante o parto. Além disso, segundo a DPU, na maioria dos casos, as mulheres são presas por tráfico de drogas e, após longo período no cárcere, acabam condenadas apenas a penas restritivas de direito.
